Agreement
By downloading, installing, or using Modulate ("the App"), you agree to these Terms of Service. If you do not agree, do not use the App.
Description of Service
Modulate is a tinnitus sound therapy application that generates therapeutic audio based on published peer-reviewed research. The App provides three sound therapy modes and tools for tracking your tinnitus management progress.
Medical Disclaimer
The App is not a medical device. It is not intended to diagnose, treat, cure, or prevent any disease or condition. The sound therapies provided by the App are based on published peer-reviewed research but have not been evaluated by the U.S. Food and Drug Administration (FDA) or any other regulatory body.
The App is not a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of a qualified healthcare provider with any questions you may have regarding tinnitus or any medical condition. Never disregard professional medical advice or delay seeking it because of something you have read or experienced in the App.
If you experience sudden hearing loss, sudden changes in tinnitus, dizziness, or ear pain, seek immediate medical attention.
Hearing Safety
The App generates audio signals delivered through headphones. You are responsible for maintaining a safe listening volume. Prolonged exposure to loud sounds can cause hearing damage. The App recommends keeping therapy volume at the lowest level at which tones are clearly audible.
License
The App is licensed, not sold, to you for personal, non-commercial use on any Apple device that you own or control, subject to the Apple Licensed Application End User License Agreement.
Intellectual Property
The App and its original content, features, and functionality are owned by B & Z Industries, LLC and are protected by applicable intellectual property laws. The therapeutic algorithms implemented in the App are based on publicly available peer-reviewed research.
Data and Privacy
The App does not collect, transmit, or share any personal data. All data is stored locally on your device. See the Privacy Policy for complete details.
Limitation of Liability
To the maximum extent permitted by applicable law, B & Z Industries, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:
- Your use or inability to use the App
- Any changes made to the App or any temporary or permanent cessation of the App
- Any outcomes related to the use of the App's sound therapy features
No Warranty
The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
The App does not guarantee any specific therapeutic outcomes. Individual results vary. The effectiveness of sound therapy depends on many factors including tinnitus type, frequency, severity, consistency of use, and individual neurological response.
Changes
These Terms may be updated from time to time. Continued use of the App after changes constitutes acceptance of the revised Terms. The "Last updated" date will be revised when changes are made.
Governing Law
These Terms are governed by the laws of the State of Washington, United States, without regard to conflict of law provisions.
